Experience

Humberto Sáenz is a lawyer with more than 25 years of experience, widely recognized in the field of arbitration and Alternative Dispute Resolution. He has participated as arbitrator and counsel in more than 60 national and international arbitrations, both institutional and ad-hoc, in sectors such as telecommunications, energy, construction, public works, banking, insurance and commercial contracts. His practice has been developed in multiple jurisdictions, including El Salvador, Guatemala, Honduras, Costa Rica, Nicaragua, Panama, Mexico, Peru and the United States.

Throughout his career, he has represented construction companies, financial institutions, industrial companies, governmental entities and individuals in arbitrations under the rules of the International Chamber of Commerce (ICC), the American Arbitration Association (AAA), the London Court of International Arbitration (LCIA) and various arbitration centers in Latin America. He has also acted in ad-hoc arbitrations under UNCITRAL rules, representing domestic and foreign investors. As an arbitrator, he has participated in more than 40 arbitration proceedings in the region and is an accredited arbitrator in the main arbitration centers of Central America, Panama and Peru.

His international recognition led him to be incorporated in 2022 in the list of investment arbitrators of the Beijing Arbitration Commission and in the list of the European Commission for appointment as president of arbitral tribunals in commercial disputes under agreements with third countries. In addition, he was arbitrator appointed by the State of El Salvador before ICSID (2014-2020) and member of the Annulment Committee of the ICSID arbitration NextEra vs. Spain, becoming the first Salvadoran to participate in a process of this type. Currently, he is a member of the ICC Court of Arbitration representing El Salvador.

In addition to his outstanding track record in arbitration, he has participated as litigation counsel in dispute boards in FIDIC infrastructure and construction contracts, and has been mediator and conciliator in corporate and corporate disputes in various national and international forums. He has also litigated in corporate, banking, administrative litigation, intellectual property, competition and public works cases.

In the corporate and regulatory area, he has advised national and international companies in mergers and acquisitions, joint ventures, international financing and financial restructurings, consolidating his profile as a reference in the region in arbitration and corporate law.
