The deadline to file the Transparency Statement in Costa Rica is about to expire.
All legal entities registered in Costa Rica must comply with a key obligation: to file the Declaration of Transparency and Beneficial Ownership Registry (RTBF) with the Central Bank.
According to the General Scope Joint Resolution DGT-ICD-R-06-2020, the deadline for filing this declaration is April 30, 2025. Failure to comply on time can have significant financial consequences for your company.
Who must file and how?
The responsibility falls on the legal representative of the company, who must carry out the procedure directly on the Central Bank’s platform using his/her digital signature.
If you do not have a digital signature, there are two alternatives:
- That the procedure be carried out by a general attorney-in-fact with no limit on the amount, or
- That a special power of attorney be granted by public deed in favor of a person who does have a digital signature. This power of attorney may be used only once, exclusively for this procedure.
What happens if I do not comply?
The omission of this obligation is not a minor matter. A fine of 2% is imposed on the gross income obtained by the legal entity or legal structure, corresponding to the fiscal period prior to the infraction.
- Minimum fine: Three base salaries.
- Maximum fine: One hundred base salaries.
Avoid penalties and comply on time.
